 Owning property in Thailand as a foreigner differs greatly from ownership rules in most other countries. That’s why it’s crucial to seek expert advice and hire a reputable Thai lawyer.

Leasehold – A maximum of 30 years, with the potential for two extensions of 30 years each.

Thai Company Setup – A preferred route for many foreign buyers.

With the second option, you can structure ownership in two ways: purchasing the land in the name of the Thai company while owning the building or structure in your own name.

Both routes involve annual fees. Leaseholders pay rent to the landlord, while company owners cover accounting costs and taxes to comply with local regulations.

Many people mistakenly believe that foreigners cannot own property in Thailand, but in reality, thousands do. The simplest option for foreign ownership is buying a condominium. However, this excludes more attractive alternatives, such as owning a pool villa, which are also available to foreigners.

Some buyers rely on online advice that exaggerates risks, but in practice, losing a home to scams or fraud is rare. These situations usually occur when buyers ignore basic legal guidance or trust the wrong people.

If you’re considering buying a home in Thailand, hiring a reputable lawyer and working with an ethical property agency is essential. Experienced agents understand the local market and use their knowledge to help clients purchase property safely.

 

The simple answer is to write a will in Thailand with a reputable lawyer if you buy property or other assets here. This service costs just a few thousand Thai Baht.

Creating a Thai will is a straightforward process that ensures your wishes are followed, even if you already have a will in another country. It’s best to have a separate Thai will specifically for your Thai assets.

 

 In Thailand there are property taxes, although capital gains tax is not recognized specifically but it is commonly referred to as income tax.

Taxes on transfers at the land department are split into 4 main elements:

1. Transfer fee 2% which is based on the higher of the evaluated price, or the actual selling price. The evaluated price is based on land department values for property which are updated every 4 years.

2. Special Business Tax (SBT) 3.3% which is applied on any property that has not been held for at least 5 years. However the foreigner cannot claim the 5 year rule as they would not have the their name in the house registration book. (excluding condominiums).

3. Stamp duty 0.5% in the registration process. This is calculated on the higher of the evaluated price and the actual selling price. It is not paid when SBT is applied to the transaction.

4. Income tax. As selling a property is income, so a tax is deducted and called withholding Tax. (this rate is between 5 – 37%)

Tax is calculated based on the Thailand Revenue Code. There are allowances for expenses on each year of ownership, for instance if a property is owned for 5 years the selling price value is reduced by 35% for expenses. The income tax levels and thresholds are then applied to calculate the tax amount payable.

i.e 0-300,000 5%, 300,000 to 500,000 10%, 500,000 to 750,000 15%, 750,000 to 1m 20%, 1m to 2m 25%, 2m to 4m 30%, over 4m 35%.

To sell your villa, your buyer will need several legal documents to inspect your rights to the property. These documents include the House Book, Chanote Title, and Building Permit. Some buyers may also request the original architect drawings.

Another important document to provide is the legal road access document, which may include a copy of the master Chanote title listing all other plots that have been granted servitude access rights.
